General Conditions for Warranty of new vehicles ("Warranty Terms")

In this supplementary document, you as the vehicle owner will find information on the smart UK warranty for new vehicles ("smart Warranty") granted by smart UK Automotive Ltd ("smart") and on the warranty conditions for your smart vehicle ("Vehicle"). If you have any questions, please contact our Customer Engagement Center in the UK ("CEC") or your local smart Authorised Service Partner.

The smart Warranty protects you as the Vehicle owner against any damage or defects to the Vehicle caused by manufacturing errors during the production of your Vehicle. The standard for assessment is the usual state of the art of comparable Vehicle models at the start of the smart warranty term (see clause 3.1 below). Your smart Warranty does not affect your rights against the seller of the Vehicle under the Consumer Rights Act 2015. Any additional and/or separate coverage based on the Integrated Service Package (ISP) remains unaffected by these Warranty Terms and are subject to the Integrated Service Package (ISP) Terms and Conditions for UK.

I. General

The following general conditions apply to your smart Warranty:

  • If you want to make a claim under this smart Warranty, you must ensure all servicing to your Vehicle have been performed in accordance with smart's specifications;
  • smart may repair the defect, replace the defective parts (through a smart Authorised Service Partner) or take other action at smart's sole discretion.
  • You must send any claims under the smart Warranty to a smart Authorised Service Partner and any repairs under the smart Warranty must be carried out by a smart Authorised Service Partner who will only use smart original parts.
  • All parts which are replaced become the property of smart.
  • All parts installed or repaired under the smart Warranty are covered by the smart Warranty for the remaining period of the initial warranty term.
  • The smart warranty is only valid within the geographical zone (see clause 2 below) and only within the smart Authorised Service Partners network. Claims under the smart Warranty can only be carried out at smart Authorised Service Partners within the geographical zone.
  • If smart provides a new Vehicle following a warranty claim, smart may demand return of the defective Vehicle.

II. Geographical Zone

The geographical scope of your smart Warranty includes the following countries: Germany, Spain, Italy, France, Portugal, Netherlands, Switzerland, Belgium, Austria, Sweden and the United Kingdom.

III. Start of smart warranty term

1.1. The warranty term begins on the date you register your Vehicle or the date of Vehicle delivery, whichever is earlier.

1.2. The warranty for spare parts or accessories begins on the date of purchase (i.e. the date of the invoice) (see clause 6.1 below).

IV. Fulfilment of warranty claims

  1. Car-Warranty

During the smart warranty term, repairs or replacements to the Vehicle that are covered by the smart Warranty will be carried out free of charge by smart Authorised Service Partners even if you sell the Vehicle to a third party during the smart warranty term. The smart warranty covers your entire Vehicle, except for certain areas for which special warranty periods apply, as set out below. The smart warranty term based on these Warranty Terms is 2 years with unlimited mileage.

  1. Warranty for the high-voltage battery and high-voltage core components

For the most important component of your Vehicle – the high-voltage battery – smart offers you a comprehensive warranty ("Battery Warranty"). If during the warranty term the state of health ("SOH") of the battery falls below 70% of the SOH at the time the Vehicle was delivered, you are entitled to a repair or replacement in accordance with the original equipment manufacturer standards based on the degree of wear, age, mileage and care condition of the Vehicle at the time the Battery Warranty claim is made. The SOH must be determined by way of battery energy content measurement performed by a smart Authorised Service Partner.

The warranty term of the Battery Warranty is:

  • 8 years or over 100,000 miles is reached, whichever comes first for the high-voltage core components (this includes an electric drive motor, a control unit and a Vehicle control unit, please refer to your high-voltage battery certificate for further information); and
  • 8 years or 125,000 miles is reached whichever comes first for the high-voltage battery itself.

The Battery Warranty does not apply if the defect was caused by improper use, handling (especially when charging) or maintenance of the battery, or is the result of an accident.

  1. Warranty for spare parts and accessories

In addition to the smart warranty, there is a separate warranty for smart genuine spare parts and smart genuine accessories purchased from a smart Authorised Service Partner ("Parts and Accessories Warranty"). The warranty term for the Parts and Accessories Warranty is 2 years without any mileage limit.

smart genuine parts and accessories are specially designed for servicing of Vehicles to meet the smart safety and reliability standards. Therefore, we recommend you only use smart genuine parts and accessories for your Vehicle. Any smart genuine parts purchased during the term of the Parts and Accessories Warranty or the Battery Warranty are covered either by the remaining time of the smart warranty term or the Parts and Accessories Warranty, whichever expires last.

  1. Corrosion protection warranty

The corrosion protection warranty covers your Vehicle in the event that the Vehicle body is perforated due to corrosion caused by manufacturing or material defects ("Corrosion Protection Warranty"). You can have the body part affected by the corrosion repaired or replaced free of charge by a smart Authorised Service Partner. The term "perforation" refers to a hole in the Vehicle body caused by corrosion from the inside or underside due to manufacturing or material defects. The term "Vehicle body" refers to metal parts of the Vehicle body, doors, fenders, roof, hood, trunk lid, or tailgate and does not include wheels and add-on parts such as light trims, bumpers, cladding, and hinges. The origin of the perforation must start on the inside of the affected body part. The term of the Corrosion Protection Warranty is 12 years without any mileage limit.

V. Warranty exclusions and limitations

  1. Different types of external damage, normal wear and tear and natural aging are excluded from the smart warranty.

In particular, the smart warranty does not cover:

  • normal wear and tear and abrasion, natural aging or fading, and normal reduction in battery capacity;
  • damage or defects caused by negligence, misuse, overloading, improper repair by an unauthorized service provider, improper care or storage;
  • damage or defects caused by failure to properly perform services and maintenance for the Vehicle in accordance with the maintenance schedules and service instructions provided in the owner's manual or indicated by the Vehicle's instrument cluster, or failure to follow instructions provided by a smart Authorised Service Provider;
  • use of non-original smart parts or materials for repairs (or of non-quality equivalent replacement parts for retail repairs) or repair procedures that have not been approved by smart as the Vehicle manufacturer;
  • damage or defects resulting from failure to comply your obligation to mitigate your losses.
  • damage or defects resulting from any conversion or modification of the Vehicle not approved by the Vehicle manufacturer.
  • damage or defects caused by the use of the Vehicle during trial/test runs, motor sport events or for purposes other than those described in the owner's manual;
  • damage or defects to Vehicles whose vehicle identification number has been altered or removed or whose mileage has been unlawfully changed;
  • damage or defects due to external impact of a mechanical or chemical nature or other incidents involving intentional acts of third parties, riots, accidents, malicious acts, theft or unauthorised use; and
  • factors beyond the control of the Vehicle manufacturer, such as environmental hazards (including industrial waste, storm damage, acid rain, bird droppings) and damages (including stone chips, scratches, and use of inappropriate cleaning materials).
  1. Vehicle modifications approved by smart are considered part of the original specification. All other modifications are not considered approved by smart and will render the smart Warranty void in respect of the affected area, unless you can prove that the modifications have not caused the defect.

Warranty coverage will be limited by smart in the following cases:

  • if smart has information that the Vehicle has been stolen;
  • if components have been impaired by unauthorised modifications, tuning or conversions; or
  • for Vehicles that have been involved in serious accidents, have been damaged by fire or have been under water and are classified as scrapped by the insurance company.
  1. Other than the claims set out in these Warranty Conditions no further claims exist under the smart Warranty. In particular, the smart Warranty does not cover any claims for compensation (e.g. the provision of a replacement Vehicle for the duration of a repair) or any claims for damages (e.g. towing costs, rental costs, compensation for use).

Nothing in these Warranty Conditions affects your right to make claims under the smart Roadside Assistance service.

We cannot exclude our liability by law in respect of death or personal injury or arising under applicable laws relating to the protection of your personal information.
